In this paper, we analyze some of the ethical dimensions of going private transactions (GPTs), wherein publicly traded firms are taken private. Financial theory suggests that efficiencies may be realized in these transactions such that outside shareholders are made better off. Empirical evidence supports this theory. We therefore argue that GPTs are not inherently exploitive or unethical. The issues of the fiduciary duty of corporate managers to shareholders and their obligations to non-shareholders are also explored.

We answer some questions about graphs that are reducts of countable models of Anti-Foundation, obtained by considering the binary relation of double-membership $x\in y\in x$. We show that there are continuum-many such graphs, and study their connected components. We describe their complete theories and prove that each has continuum-many countable models, some of which are not reducts of models of Anti-Foundation.

In this book, John Dryzek criticizes the dominance of instrumental rationality and objectivism in political institutions and public policy and in the practice of political science. He argues that the reliance on these kinds of politics and to technocracies of expert cultures that are not only repressive, but surprisingly ill-equipped for dealing with complex social problems. Drawing on critical theory, he outlines an alternative program for the organization of political institutions advocating a form of communicatively rational democracy, which he (...) terms discursive democracy, that stresses the importance of active citizenship and public discourse. He draws out the limitations of instrumental rationality and investigates how policy analysis and political science may be reformed to help constitute and comprehend democracy. Discursive Democracy examines how the political process can be made more vital and meaningful. We critically evaluate arguments in a recent Journal of Law, Medicine & Ethics article by Svoboda, Adler, and Van Howe disputing the 2012 affirmative infant male circumcision policy recommendations of the American Academy of Pediatrics. We provide detailed evidence in explaining why the extensive claims by these opponents are not supported by the current strong scientific evidence. We furthermore show why their legal and ethical arguments are contradicted by a reasonable interpretation of current U.S. and international law and ethics. (...) After all considerations are taken into account it would be logical to conclude that failure to recommend male circumcision early in infancy may be viewed as akin to failure to recommend childhood vaccination to parents. In each case, parental consent is required and the intervention is not compulsory. Our evaluation leads us to dismiss the arguments by Svoboda et al. Instead, based on the evidence, infant male circumcision is both ethical and lawful. (shrink)

Exclusively instrumental notions of rationality not only reinforce attitudes conducive to the destruction of the natural world, but also undermine attempts to construct environmental ethics that involve more harmonious relationships between humans and nature. Deep ecologists and other ecological critics of instrumental rationality generally prefer some kind of spiritual orientation to nature. In this paper I argue against both instrumental rationalists and ecological spiritualists in favor of a communicative rationality which encompasses the natural world. Geoffrey Rose’s prevention paradox points to a tension between two prima facie plausible moral principles: that we should save the greater number and that weshould save the most at risk. This paper argues that a novel moral theory, ex-ante contractualism, captures our intuitions in many prevention paradox cases, regardless of our interpretation of probability claims. However, it goes on to show that it might be impossible to square ex-ante contractualism with all of our moral intuitions. It concludes that even if (...) ex-ante contractualism cannot furnish an entire ethics of risk, it does identify important considerations for any such theory. (shrink)

In this paper, I set out two ethical complications for Rid and Wendler’s proposal that a “Patient Preference Predictor” (PPP) should be used to aid decision making about incapacitated patients’ care. Both of these worries concern how a PPP might categorize patients. In the first section of the paper, I set out some general considerations about the “ethics of apt categorization” within stratified medicine and show how these challenge certain PPPs. In the second section, I argue for a more specific—but (...) more contentious—claim that proper respect for the autonomy of incapacitated patients might require us to act on reasons which they could endorse and show how this claim places important limits on the categories employed by an ethically acceptable PPP. The conclusion shows how these concerns about apt categorization relate to more familiar worries about Rid and Wendler’s proposals. (shrink)

Ever since Darwin people have worried about the sceptical implications of evolution. If our minds are products of evolution like those of other animals, why suppose that the beliefs they produce are true, rather than merely useful? We consider this problem for beliefs in three different domains: religion, morality, and commonsense and scientific claims about matters of empirical fact. We identify replies to evolutionary scepticism that work in some domains but not in others. One reply is that evolution can be (...) expected to design systems that produce true beliefs in some domain. This reply works for commonsense beliefs and can be extended to scientific beliefs. But it does not work for moral or religious beliefs. An alternative reply which has been used defend moral beliefs is that their truth does not consist in their tracking some external state of affairs. Whether or not it is successful in the case of moral beliefs, this reply is less plausible for religious beliefs. So religious beliefs emerge as particularly vulnerable to evolutionary debunking. The Congregation of the Doctrine of the Faith’s Dignitas personae does not offer a definitive rejection of the practice of human embryo adoption as intrinsically evil, but neither does it simply leave the matter an “open question.” The document does indeed oppose the practice, but its reasons for doing so are not clearly stated and seem to be in tension with its own affirmations of the personal dignity of embryos and the goodness of adoption. The Congregation’s opposition is therefore best (...) read as a prudential judgment that embryo adoption cannot be justified in the present circumstances due to the potential for scandal and the cooperation with the fertility industry which it involves. Understanding of the logic of language games makes a difference to those one will play. Compare Heraclitus. The form of life as the will, prana, that which determines whatever it is that is said or believed. The language is merely the medium. Yet this is not something to be set up (...) as a metaphysical theory. It is too particular, and any motive for demolishing it is likely to be sufficient to do so. There is no one way which is true over and above all others. To be able to talk on this plane we need a kind of higher logic. There are those who are desperate to discover the one explanation which is in a sense true. For them, an philosophy which focus on the nature of explanation itself, and thus dissolves the problem will appear irrelevant. Henceforth what is needed is not philosophical statements but logical tools. What we do with these tools is not the business of philosophy. 'one wonders what philosophy would have been like in Britain and the United States if it had not been for the accident of Wittgenstein, for he might not have been on the scene at all…. I meant that he became known to the world of philosophy through the very special circumstances of making a strong impression on Bertrand Russell, and being accepted into the world of philosophy through the bold initiative of Cambridge. A number of consequences for infinite models of the theory of finite groups are described.

Arguments against essentialism in biology rely strongly on a claim that modern biology abandoned Aristotle's notion of a species as a class of necessary and sufficient properties. However, neither his theory of essentialism, nor his logical definition of species and genus (eidos and genos) play much of a role in biological research and taxonomy, including his own. The objections to natural kinds thinking by early twentieth century biologists wrestling with the new genetics overlooked the fact that species have typical developmental (...) cycles and most have a large shared genetic component. These are the "what-it-is-to-be" members of that species. An intrinsic biological essentialism does not commit us to Aristotelian notions, nor even modern notions, of essence. There is a long-standing definition of "species" and its precursor notions that goes back to the Greeks, and which Darwin and pretty well all biologists since him share, that I call the Generative Conception of Species. It relies on there being a shared generative power that makes progeny resemble parents. The "what-it-is-to-be" a member of that species is that developmental type, mistakes in development notwithstanding. Moreover, such "essences" have always been understood to include deviations from the type. Finally, I shall examine some implications of the collapse of the narrative about essences in biology. Swedenborg's Principles of Usefulness presents a possibly unsuspected historical undercurrent that further evidences Emanuel Swedenborg's pervasive influence on a whole host of historical figures-from poets and artists to philosophers and statesmen-whose contributions to the evolution of self and society have resonated throughout time and into the present. Besides having an impact on individual thinkers, Swedenborg's ideas worked their way into the various social reform traditions that vitalized the American landscape during the nineteenth and early-twentieth centuries. His concept of usefulness, best (...) demonstrated in the competing worldviews of the nation's liberal and conservative traditions, involved a commitment made by Swedenborgians, New Church members, and others to energize the nation and its people by envisaging the possibility of a much-desired Universal Human. Now a section in my 2018 book _Species: The evolution of the idea_. -/- It is often claimed that species are the units of evolution, but this is not defined or clearly explained. In this paper I will argue that species are phenomenal objects that stand in need of explanation, but that they are not objects required by any theory of biology. I further define, or rather describe, species as the genealogical cluster of various lineages at the genetic, haplotype, genomic, (...) organismic, and population level, in keeping with my previous discussions. David Hull's (1988c) model of science as a selection process suffers from a two-fold inability: (a) to ascertain when a lineage of theories has been established; i.e., when theories are descendants of older theories or are novelties, and what counts as a distinct lineage; and (b) to specify what the scientific analogue is of genotype and phenotype. This paper seeks to clarify these issues and to propose an abstract model of theories analogous to particulate genetic structure, in order to reconstruct (...) relationships of descent and identity. Over the past few years, blogging (“web logging”) has become a major social movement, and as such includes blogs by scientists about science. Blogs are highly idiosyncratic, personal and ephemeral means of public expression, and yet they contribute to the current practice and reputation of science as much as, if not more than, any popular scientific work or visual presentation. It is important, therefore, to understand this phenomenon.

This paper uses the controversy surrounding abstinence-only education to depict the current struggle between US government policy and science. The paper demonstrates the way in which this fight over science has become a communications battle and how the internet has become the vehicle through which ideology is able to masquerade as science. In addition, this paper identifies the damage to public health programs, and the ethical problems of providing selected information and misinformation to teenagers. Part of the resolution may be (...) for scientists to become better communicators to the public about scientific principles and findings. If scientists are interested in improving sexuality education, we need to rely on science but may find it more advantageous to reframe our arguments around themes that perhaps have greater cultural salience. Jonathan Aldred shares our desire to promote a reconciliation between social choice theory and deliberative democracy in the interests of a more comprehensive and compelling account of democracy.1 His comments on some details of our analysis – specifically, our use of Arrow’s conditions of universal domain and independence of irrelevant alternatives – give us an opportunity to clarify our position. His discussion of the independence condition in particular identifies some ambiguity in our exposition, and as such is useful. We are (...) less impressed by the way Aldred characterizes the overall terms of the reconciliation we propose. We believe that his argument on this matter should be resisted because it provides deliberative democrats with a bad excuse to dismiss social choice theory altogether, which is surely not what he intends. For contemporary democratic theorists, democracy is largely a matter of deliberation. But the recent rise of deliberative democracy (in practice as well as theory) coincided with ever more prominent identity politics, sometimes in murderous form in deeply divided societies. This essay considers how deliberative democracy can process the toughest issues concerning mutually contradictory assertions of identity. After considering the alternative answers provided by agonists and consociational democrats, the author makes the case for a power-sharing state with attenuated sovereignty and a (...) more engaged deliberative politics in a public sphere that is semidetached from the state and situated transnationally. This paper informally summarizes a two-day symposium held at the U.S. National Academy of Sciences in Washington, D.C., September 5–6, 2002. The issue was to what extent the progress of science and societal capacity for continued technological innovation are threatened by excessive protection of intellectual property. Excessive protection creates disadvantages not only for scientists and inventors but also for educators/students and for librarians/clientele. Speakers from a variety of disciplines and institutions agreed unanimously that scientific and technological progress is, indeed, under (...) serious threat. Various opinions were expressed about the degree of threat, currently and prospectively, as well as what counter-measures are best suited to resist undue restrictions on creative uses of scientific and technical data and information. This summary is based entirely on the author’s notes from the symposium, and the commentary offered is his alone. My apologies to the speakers if this paper does not accurately reflect the primary intent of their presentations. The “Suggested Readings” offered at the end are not specific to the speakers’ statements but rather are offered as a general resource to aid further research. It is often claimed there is information in some biological entity or process, most especially in genes. Genetic “information” refers to distinct notions, either of concrete properties of molecular bonds and catalysis, in which case it is little more than a periphrasis for correlation and causal relations between physical biological objects (molecules), or of abstract properties, in which case it is mind-dependent. When information plays a causal role, nothing is added to the account by calling it “information”. In short, if (...) genetic information is concrete, it is causality.
